MarHire ("MarHire", "we", "us", "our") is a registered travel company based in the United States and Morocco. We operate as a trusted platform that markets and manages travel services in Morocco.

1) Acceptance of Terms

By accessing our Website, creating an account, making an inquiry, or completing a booking, you ("Customer", "you") agree to these Terms & Conditions ("Terms") and to any service-specific conditions shown on the listing page, checkout, and voucher/confirmation. If there is a conflict, the listing/voucher terms prevail for that booking.

We may update these Terms periodically; the version posted with a new effective date applies to future bookings.


2) Definitions & Our Role

Platform: The MarHire website, communications, and booking processes.

Partner: An independent supplier that provides the underlying service (e.g., rental agency, chauffeur operator, boat owner, activity provider).

Voucher/Confirmation: The binding booking confirmation you receive after payment/approval; it includes key terms (dates, inclusions, pickup, contact).


3) Eligibility & Customer Responsibilities

  • You must be 18+ and meet service-specific rules (age, licence, fitness).
  • Provide accurate details (names, contacts, flight info, licence) and keep them updated.
  • Read the listing and voucher; arrive on time with required documents and payment method.
  • Follow local laws and the Partner's on-site instructions.

4) Quotes, Availability & Booking Formation

  • Quotes are indicative until confirmed in writing (email/voucher).
  • A booking exists only when a MarHire confirmation is issued.
  • We may decline bookings that are unsafe, fraudulent, or unavailable.
  • Minor specification changes (e.g., "or similar" vehicle within the same class) may occur; MarHire may provide an equivalent or higher category if the exact model is unavailable.

5) Pricing, Currency & Taxes

  • Prices are shown in EUR (viewable in MAD/USD in some cases). Your bank's FX rate/fees are outside our control.
  • Prices generally include mandatory insurance (see Insurance Conditions) unless stated otherwise on the listing.
  • Optional extras (e.g., child seats, extra driver, fuel, port fees, attraction tickets) may be payable locally to the Partner.

6) Payments, Deposits & Security Holds

All bookings require partial or full prepayment to MarHire, while the remaining balance may be paid upon arrival, if stated during checkout or on your booking confirmation.

We use Stripe and other approved payment methods to process online payments securely. By making a payment, you authorize MarHire and its payment service providers, including Stripe, to charge the payment method you provide for the applicable booking amount and any other authorized charges under these Terms.

For most bookings, a percentage of the total amount is paid online to confirm and secure the booking, with the remaining balance paid upon pickup or service start, where applicable.

For car rental, a security deposit may be requested at the start of the rental depending on the insurance plan assigned to the vehicle:

  • Plan 1  Standard with Deposit: A refundable security deposit is collected at pick-up. Payment is by cash by default; card payment is accepted where a card machine is available at the pick-up location.
  • Plan 2  Standard without Deposit / Plan 3 Premium without Deposit: No security deposit is collected at pick-up.

The insurance plan applicable to your vehicle is always displayed on the listing page and confirmed on your voucher.


7) Force Majeure & Safety

If delivery is impossible or unsafe due to events beyond reasonable control (e.g., severe weather, port/road closure, natural disaster, strikes, civil authority orders), you may select a free reschedule or a full refund. For weather-dependent boats/activities, the operator or captain decides per local rules.


8) Insurance & Damage (Summary)

All car rentals include Third-Party Liability and Full Insurance (CDW) for the rented vehicle. Every rental is assigned one of three insurance plans:

  • Plan 1 Standard with Deposit: Full insurance with excess. The driver pays up to the excess cap if at fault. A refundable security deposit is required at pick-up (cash by default, card where available).
  • Plan 2 Standard without Deposit: Full insurance with excess. The driver pays up to the excess cap if at fault. No security deposit required.
  • Plan 3 Premium without Deposit: Full insurance with no excess. The driver pays €0 regardless of fault. No security deposit required. Minimum driver age is 30 years old.

What "full insurance" means in practice:

  • Driver at fault: The driver pays up to the excess cap applicable to their plan (Plans 1 and 2), based on the actual repair cost — never more than the cap and never more than the actual damage. Plan 3 drivers pay €0.
  • Driver not at fault: The driver pays €0 across all plans, provided a full accident report is submitted and the insurer confirms non-fault.

Excess caps by vehicle category (Plans 1 & 2): Economy/City ≈ €500–€700 · Compact/Family ≈ €700–€900 · SUV/4×4 ≈ €1,000–€1,900 · Premium/Luxury ≈ €2,000–€6,500. The exact excess for your vehicle appears on your car documentation at pick-up.

Zero excess when not at fault (all plans): If an accident occurs and you are not at fault, you pay €0 provided you supply a full accident report (police report or signed constat amiable with third-party details) and the insurer confirms non-fault. Notify MarHire immediately and submit documents within 24 hours (or the next working day).

If liability is shared, undetermined, or the third party is unknown (hit-and-run), the excess applies (fully or proportionally) until liability is confirmed. Plan 3 carries no excess in any scenario.

Glass & Windscreen: Damage to the windscreen, windows, and mirrors is covered under all three plans. No add-on is required.

Common exclusions: DUI/reckless driving; unauthorised drivers; off-road use; negligence (e.g. keys left in vehicle); wrong fuel; clutch/gearbox misuse; undercarriage damage; wheels and tyres; lost keys; personal belongings. A police or insurer's accident report is always required — without it, the client is liable for the full cost of all damage regardless of plan.

9) Category-Specific Terms

A) Car Rental

Eligibility: Minimum 21+ years old with 2+ years of valid driving licence for Plans 1 and 2; minimum 30+ years old for Plan 3 (Premium without Deposit). Higher limits may apply for certain vehicle categories. An IDP may be required for some licences. Only named drivers listed on the rental agreement may drive.

Use & Territory: Morocco only, paved public roads; no off-road/competition. Obey traffic/parking rules.

Pick-up/Return: Bring passport, valid driving licence (IDP if needed), and cash for the deposit where applicable (Plan 1 — card accepted where a card machine is available). Return on time, in the same condition, at the agreed fuel level. Late returns incur extra charges.

Car Rental Mileage: Unlimited kilometres apply on rentals of more than 6 days. This will be shown on the vehicle page and on your voucher. For rentals of 6 days or less, our agent will review and approve your travel plan (main routes/cities) at pick-up. If you later drive beyond the agreed plan without prior approval, a non-compliance mileage fee will apply starting from €40, adjusted to the distance and impact on the vehicle/contract. To update your plan, contact us by WhatsApp or email and obtain written approval before you travel.

Fees & Fines: You are responsible for all traffic/parking fines, tolls, and related administrative fees incurred during your rental. These may be charged during or after the rental when notices are received.

Cleaning Fees: All vehicles are delivered clean and must be returned in the same condition. If a vehicle is returned dirty, a €10 cleaning fee will apply. If a vehicle is returned excessively dirty and requires deep cleaning, a €30 cleaning fee will apply. This includes, but is not limited to, smoking residue, spills, stains, excessive sand or dirt, and pet hair or odours.

Breakdown/Accident: Call support; follow Partner/insurer instructions. Do not authorise repairs without approval. Replacement vehicles depend on availability and incident type.

B) Private Driver & Transfers

Scope: Point-to-point or hourly services operated by licensed drivers.

Waiting Time: Reasonable airport waiting when valid flight details are provided; extra waiting may be chargeable. En-route changes (stops/route changes) may affect price/timing.

Luggage & Child Seats: Declare luggage volume; request child/booster seats in advance (fees may apply). Operators may refuse unsafe configurations.

Conduct & Safety: Seatbelts required; no alcohol/drugs that compromise safety.

C) Boats & Sea Trips

Safety & Crew: Operate per maritime rules and captain's decision on weather/sea state. Lifejackets/safety briefings may be mandatory.

Equipment: You are responsible for damage/loss caused by misuse (e.g., snorkel gear, fishing rods).

Timings & Ports: Departure/return windows are coordinated with port authorities; late arrival/no-show may forfeit the trip per cancellation rules.

D) Activities & Tours

Eligibility & Health: Minimum ages, weight/fitness, or medical limits may apply (e.g., quad/buggy, balloon). You agree to follow guide/operator instructions and sign any required waivers.

Tickets & Passes: Certain third-party tickets are non-refundable once issued (clearly shown on the listing).

11) Reviews & User Content

By submitting reviews, photos, or feedback, you grant MarHire a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for marketing and quality purposes. We may moderate or remove unlawful, abusive, or irrelevant content.


12) Fraud, Chargebacks & Security

We may cancel bookings suspected of fraud or misuse. If you initiate a chargeback while a refund is in progress, we may pause the refund until your card issuer resolves the dispute to prevent double credit.


13) Privacy & Cookies

Your personal data is handled under our Privacy Policy and Cookies Policy (available on our site). Contact [email protected] to exercise privacy rights.


14) Intellectual Property & Website Use

All content, trademarks, and code on the Website are owned by or licensed to MarHire and protected by IP laws. You agree not to scrape, copy at scale, reverse engineer, or misuse the Website or booking flows.


15) Availability of Platform

We aim for continuous availability but do not guarantee uninterrupted access. Maintenance, upgrades, or network issues may cause downtime. We may alter, suspend, or discontinue any part of the Platform at any time.


16) Liability & Disclaimers

To the maximum extent permitted by law, MarHire's total liability for any claim related to a booking is limited to the amount you paid to MarHire for that booking.

We are not liable for indirect, incidental, special, or consequential losses, or for events outside our reasonable control (force majeure).

Partners are independent businesses; they are solely responsible for the quality, safety, and delivery of their services.

Nothing in these Terms limits liability that cannot be limited under applicable law.


17) Severability, Assignment, No-Waiver, Entire Agreement

If any provision is invalid or unenforceable, the remainder remains in effect. You may not assign your rights without our consent. Our failure to enforce a term is not a waiver. These Terms, together with the voucher and listing conditions, are the entire agreement for your booking.


18) Governing Law & Jurisdiction

These Terms are governed by Moroccan law. The Courts of Agadir (Souss-Massa) have non-exclusive jurisdiction, without prejudice to any mandatory consumer rights under applicable law.
